By accessing or using this Website, you agree to be legally bound by these Terms, as well as our Privacy Policy and Cookie Policy, which are incorporated herein by reference. If you do not agree with any part of these Terms, you must immediately cease using this Website.

3. Use of the Website

You are granted a limited, non-exclusive license to access and use this Website for the purposes of obtaining information about our services and, where applicable, making and managing corporate travel bookings. You agree not to use this Website for any unlawful purpose.

4. Booking and Payment Process

• Quotations: All quotations are subject to availability from third-party suppliers and are not guaranteed until a booking is confirmed. Prices are subject to change due to factors beyond our control, such as currency fluctuations, fuel levies, and supplier price increases.

• Booking Confirmation: A booking is considered confirmed only upon our receipt of the required payment and your acceptance of the booking details.

• Payment: Payment terms and deadlines will be specified in your quotation or invoice. Failure to make payment by the due date may result in the automatic cancellation of your booking.

• Review of Transaction: In compliance with ECTA, before you finalize any booking, you will be provided with an opportunity to review the entire transaction, identify and correct any errors, and withdraw from the transaction before placing a final order.

5. Our Role as an Intermediary and Consumer Protection

• Intermediary Services: Destini acts as an intermediary agent, facilitating bookings between you and third-party suppliers of travel services. In compliance with Section 27 of the Consumer Protection Act, we disclose that we are acting on behalf of these third-party suppliers.¹²

• Consumer Protection Act (CPA): We are committed to upholding your rights as a consumer under the CPA. No provision in these Terms is intended to limit or exempt us from liability for any loss directly or indirectly attributable to our gross negligence or to constitute an assumption of risk by you for such loss.¹¹

6. Liability

As an intermediary, we are not liable for the acts, omissions, or defaults of third-party suppliers. Our liability is limited to losses arising directly from our own gross negligence or wilful misconduct in the provision of our intermediary services. It remains the sole responsibility of the individual traveller to ensure they possess all necessary and valid travel documents. We shall not be held liable for any loss or expense incurred due to the traveller's failure to comply with these requirements.

7. Data Protection and Privacy

We collect and process personal information in order to provide our services. All personal information is handled in strict compliance with our Privacy Policy and the Protection of Personal Information Act (POPIA). By using our services and providing personal information for travellers, you warrant that you have the authority to do so and that you have made the travellers aware of our Privacy Policy. Our website uses cookies as detailed in our Cookie Policy.

8. Security and Cyber Crime

In accordance with ECTA, we implement reasonable technical and organizational security measures to protect our information systems from unauthorized access or misuse. However, we cannot guarantee the absolute security of information transmitted over the internet. You agree not to engage in any activity that could damage, disable, or impair the functionality of the Website, including the distribution of malicious software.

9. Force Majeure and Extraordinary Circumstances

We shall not be liable for any failure or delay in performance of our obligations under these Terms arising out of or caused by, directly or indirectly, forces beyond our reasonable control, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, pandemics, and interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services ("Force Majeure Events").

10. Cancellations, Amendments, and Refunds

Should you need to cancel or amend a confirmed booking, you must notify us in writing. Cancellation and amendment penalties will apply. These penalties are determined by the terms and conditions of the relevant third-party suppliers and may amount to 100% of the booking value. We may also charge a reasonable service fee for processing the change. Any applicable refunds will only be processed after we have received the refunded amount from the relevant supplier.

11. Intellectual Property

All content on this Website, including text, graphics, logos, and software, is the property of Club Corporate Travel (Pty) Ltd T/A Destini or its content suppliers and is protected by South African and international copyright laws.

12. Governing Law and Jurisdiction

These Terms and your use of the Website shall be governed by and construed in accordance with the laws of the Republic of South Africa. You agree to submit to the exclusive jurisdiction of the courts of South Africa for the resolution of any disputes arising out of these Terms.
